Supreme Court dismisses plea by Abdullah Azam Khan to quash forgery charges to get passport

The Supreme Court on Thursday, November 6, 2025, refused to intervene in the plea of former Uttar Pradesh MLA Muhammad Abdullah Azam Khan, son of Samajwadi Party leader Azam Khan, to quash charges of procuring passports using forged documents.
“We are not inclined to intervene,” Justice MM Sundresh, who headed the bench, told senior advocate Kapil Sibal, appearing on Mr Khan’s behalf.
The Allahabad High Court had earlier refused to quash the criminal case, prompting the former MLA to approach the Supreme Court.
“The Court has the freedom to decide all matters without being affected by the decision of the Supreme Court,” the Supreme Court Bench said.

BJP MLA Akash Saxena had filed a case against Mr. Khan in Rampur on July 30, 2019, alleging fraud and violation of the Passport Act for allegedly obtaining the travel document using wrong date of birth.
According to the complaint, Mr. Khan was issued a passport on January 10, 2018. While the passport stated his date of birth as September 30, 1990, his education certificates showed January 1, 1993.
The case was registered in Rampur district. Mr. Khan will be tried before Special MP/MLA Judge Rampur. The charges in the case were framed on September 9, 2021.
