Revealed: Ex accused of killing British mother-of-three in Spain had restraining order against him as it emerges her children who were in the house raised alarm ‘by pressing panic button’

It has been revealed that the estranged husband of the man accused of murdering a British mother of three in Spain has filed a restraining order against her.
Hairdresser Victoria Hart, 33, was stabbed to death yesterday at her family’s home in the La Paca area of Alhaurin el Grande, Malaga.
According to local media reports, he was found in a pool of blood with a kitchen knife next to his body.
A source close to the family told the Daily Mail that they believed she had been murdered in front of her children, and then pressed the panic button in the house and raised the alarm.
Her ex, Juan Antonia Rueda, was arrested after turning himself in at a nearby prison and telling cops: ‘Arrest me, I’ve done a very bad thing.’
“He (her husband) had been banned by the police but somehow got into the house,” the source told the Mail.
‘I think the kids saw it. Victoria was trying to divorce him because he hit her. The police forbade him from entering the house, but he managed to get inside. I was told that it was the children who pushed the panic button.
‘I think he was trying to move on but I don’t know if he had a new partner.
‘The family has lived in Spain for many years, I don’t know why they moved; Maybe for a better life.’
Victoria is understood to be in the process of separating from Juan, who has a restraining order preventing him from approaching the home where his wife and three children live.
The source added: ‘I don’t know who will look after the children or whether they are capable of doing so. They were all very, very close.’

The Spanish newspaper said Juan was seen in a bakery near his father’s chicken restaurant on the day of the murder.
Concerned staff asked him how he felt ‘because he looked serious’ and he replied: ‘I am’.
Victoria was attacked an hour later at around 11.40am, with her screams warning neighbors to call the police.
Local reports said her eldest child, an 11-year-old with two seven-year-old twin sisters, ran into the garden of the settlement where they lived, a 50-minute drive from Marbella, and asked for help.
The teenager is also said to have called his grandmother after his mother was attacked.
Alhaurin el Grande Municipal Council announced that a day of mourning will be declared tomorrow at 17:00 with a minute of silence in memory of Victoria.
Heartfelt tributes to Victoria poured in on social media, with one friend saying: ‘RIP Victoria Hart. This is devastating news. We need to stand against domestic violence in this country and work against those who protect these animals.
‘My prayers are with the family at this terrible time.’
In a message to a relative believed to be Victoria’s mother, Elaine Mawer said: ‘I am heartbroken. This should never have happened.
‘They are poor children. We extend our deepest condolences to Sue Hart and all her family. Victoria will be sadly missed.’
Joanne Wilson wrote: ‘There are no words in this world that can describe a beautiful person, a wonderful mother, a wonderful friend. Victoria Hart you will be missed.
‘I’m heartbroken and still can’t believe it. RIP my angel. I will miss you more than anyone in this world could ever imagine.
‘Sending my love to the children’s mother, Sue, Gemma and all your family.
‘There aren’t many people as perfect as Victoria Hart.’

A Civil Guard spokesman in Malaga said yesterday: ‘The Civil Guard is investigating the death of a woman in Alhaurin el Grande.
‘His former partner, the alleged murderer, was arrested.’
Little has been revealed about the suspect so far, but Spanish media have reported that he is a former semi-professional football player who previously played for Spain’s Tercera Federación.
It was also revealed last night that the victim was registered with VioGen, Spain’s monitoring and protection system for women subjected to gender or domestic violence.
Neighbors claimed that the couple’s relationship was on the rocks before their deaths and they were in the process of breaking up.
They told local media outlet Sur that the woman was out with friends on Friday afternoon and her partner texted her repeatedly throughout the evening to find out her whereabouts.
In a statement, the Alhaurín el Grande Municipal Council said: ‘Ayuntamiento de Alhaurín el Grande calls on citizens to join the citizens’ mourning rally that will take place next Monday, January 26, at 17:00 in the Town Hall Square, where a minute of silence will be observed in memory of the murdered woman victim of gender-based violence in our town.
‘We once again express our strongest reaction and condemnation of this terrible act of violence, and we also extend our solidarity and support to the family and relatives of the victim.
The City Council reiterates its commitment to combating gender-based violence and calls for unity in society to eliminate all forms of violence against women.
