The Supreme Court will on Monday, February 16, 2026, hear petitions seeking action against Assam Chief Minister Himanta Biswa Sarma over a viral video that allegedly shows him aiming and firing a rifle at members of a particular community.
According to the apex court’s case list, a bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi is likely to hear the case.
On February 10, the high court had agreed to list the demands of Left leaders seeking action against Sarma.

Referring to the upcoming assembly elections in Assam, the high court said that the problem was that some of the elections were held before it.
The lawyer appearing on behalf of several CPI and CPI(M) leaders had noted Nizam Pasha’s submissions against Mr. Sarma and said he would consider listing the defence.
The video, in which Sarma allegedly aims a rifle and fires at two people, one with a hat and the other with a beard, was shared by the Assam BJP on its official X account on February 7.

The controversial post sparked widespread outrage and political condemnation. He was deleted by the BJP after he was accused of inciting violence and communal hatred.
Communist Party of India (Marxist) and CPI leader Annie Raja filed separate pleas seeking registration of FIRs against Mr. Sarma for alleged hate speech aimed at social polarization.
It has also been requested from the top court to set up a special investigation team (SIT) on the grounds that an independent investigation is not expected from the state and central institutions.
In the defenses listed in chronological order, it was claimed that Mr. Sarma had provocative speeches and statements.
Previously, a separate petition was submitted by 12 people on the issue, requesting guidance to prevent divisive comments from people in constitutional positions.
