Judge rules against Deion Sanders’ son Shilo in bankruptcy lawsuit, will go to trial

“The Court’s role in deciding the Motion to Dismiss is not to resolve factual disputes or weigh potential evidence outside the four corners of the Complaint,” Judge Michael Romero wrote in his March 4 decision. “The trustees have adequately alleged the necessary elements of their allegations. They also supported their allegations with sufficient factual allegations regarding Sanders’ bank accounts, the deposit of NIL proceeds into the Big 21 Account, and Sanders’ control over Big 21 and the Headache Gang. Proving the trustees’ allegations is a matter to be decided at trial.”

What is this lawsuit against Shilo Sanders about?

This decision is separate from the bulk of Sanders’ bankruptcy case, which is scheduled to go to trial on Aug. 31, and does not concern the trustee.

The biggest issue in the trustee’s lawsuit against Sanders is who the money in question belongs to: the bankruptcy estate or Sanders. While Sanders’ earnings before filing the bankruptcy petition generally belong to the bankruptcy estate for the benefit of creditors, earnings from the business after the filing belong to Sanders.

What did the judge’s decision against Shilo Sanders mean?

Sanders’ lawyer Keri Riley said in court that she documented the money in question belonged to Sanders because these were “post-petition gains”.

The trustee objects to this and requests an accounting. The judge basically said that this was an issue to be decided later at the hearing, not a motion to dismiss.

“Determining the true nature of the funds will require the presentation of evidence and the resolution of numerous factual issues,” the judge ruled. “For example, whether the funds constitute Sanders’ pre- and post-petition earnings will depend on the type of services Sanders performed, when he performed them, and the terms of the contract(s), if any, requiring those services.”

Why did Shilo Sanders file for bankruptcy?

Shilo, 26, is Deion Sanders’ middle son. Did not get into debt due to unpaid loans or overspending on credit cards. Instead, he was hit with a civil court ruling in Dallas in 2022 that resulted in him being hit with a $11.89 million penalty, all due to one man. Darjean filed a lawsuit against Sanders in 2016, claiming that Sanders suffered permanent and severe injuries as a result of punching and elbowing Shilo in the head and neck area at school in 2015, when she was 15 years old. Sanders claimed it was self-defense, but He did not come to the hearing in 2022which led to a default judgment against him.

Sanders filed for Chapter 7 bankruptcy in 2023 after Darjean took action to collect on that debt. Sanders’ goal is to have this debt erased in bankruptcy court. But Darjean is fighting this, arguing that the law does not allow him to pay the debt in this case because the debt resulted from an “intentional and malicious” injury.

This is the subject of the hearing to be held on August 31. This separate trustee case does not yet have a hearing date.

Shilo Sanders is currently away from football but worked as an influencer and after recently moving to Miami, she considered taking acting classes. She and her sister, Shedeur Sanders, also recently appeared as models in Paris.
