Education Department concludes Colorado district violated Title IX rights

The U.S. Department of Education’s Office for Civil Rights (OCR) has concluded that a school district in Colorado violated federal civil rights law by allowing male students to access women’s restrooms, locker rooms and overnight accommodations and to compete in girls’ sports.

In findings released Friday, OCR determined that Jefferson County Public Schools violated Title IX.

The announcement stated that OCR received athletic rosters from Jefferson County and that the rosters show “male students may hold up to 61 roster positions on girls’ sports teams in the area.”

OCR said the policies hinder girls’ “safety, dignity, and equal access to educational programs and activities.”

“Today’s findings reveal extensive Title IX violations by Jefferson County Public Schools, denying justice and equality to female students by allowing boys access to private facilities, overnight accommodations, and athletics,” Assistant Secretary for Civil Rights Kimberly Richey said in a statement.

“The district’s decision to prioritize ‘gender identity’ over providing equal access to female students is unconscionable.” Richey said. “The region must act now to end these abuses and protect future generations of girls from gender discrimination. The Trump administration will not step back until the safety, opportunities, and equal protection of female athletes under the law are fully ensured.”

The Civil Rights Administration issued a proposed settlement agreement to the district that gives officials 10 days to voluntarily comply or face possible federal sanctions.

The investigation began in June 2025, when OCR launched an investigation into allegations that Jefferson County Public Schools had eliminated measures requiring single-sex overnight accommodations on district-sponsored trips.

Federal investigators said their investigation uncovered broader violations, concluding that the district also allowed male students to access women-only facilities and compete on girls’ teams.

Title IX, enacted in 1972, prohibits discrimination based on sex in educational programs or activities that receive federal funding.
