Earlier this week, the former Las Vegas artist was charged with driving under the influence and is scheduled to be arraigned in Ventura County Superior Court on Monday.

A hearing is the first formal court appearance in a criminal case where the defendant is notified of the charges against him, advised of his rights, and enters a guilty, not guilty, or no contest plea.

It is not yet known whether the Toxic star plans to attend the hearing in person on Monday.

The Ventura County District Attorney’s Office said in a statement to the Daily Mail: ‘The decision on whether Ms. Spears will attend the hearing will be made between her and her attorney.

‘As this is a misdemeanor charge, he does not need to attend and his attorney can attend the hearing on his behalf.’

The District Attorney’s Office confirmed that Britney will face the same ‘protocols’ as everyone else.

The following statements were used in the statement: ‘This drunk driving case will be handled according to our standard protocols. For defendants who have no prior drunken driving history, have a low blood alcohol level, and have not been involved in an accident or injury, prosecutors often make an offer known as “wet recklessness.”

‘This law allows the defendant to plead guilty to careless driving involving alcohol and/or drugs.’

The District Attorney’s Office also explained that such scenarios are common “especially in cases where the defendant demonstrates self-motivation to resolve underlying problems through rehabilitation or a drug and alcohol treatment program.”

‘Under this proposal, the defendant would be placed on probation for 12 months, receive credit for time spent in custody, must complete DUI coursework, and must pay state-mandated fines and fees. This offer will also be presented to Ms. Spears on Monday.’
