Flat owners to gain new rights to request faster broadband in leasehold overhaul

Flat owners are set to gain new rights to demand faster broadband as part of reforms to overhaul the rental system.

With the approval of the Shared Ownership and Leasehold Reform Bill in the King’s Speech, the Government plans to introduce a new right to request a faster broadband connection and further strengthen leaseholder protection.

The new right is intended to include the bill as it enters Parliament to address a common frustration experienced by flat owners in England and Wales.

The government said that under the plans, leaseholders would have a legal right to demand fast, reliable broadband connections and that the request could not be unreasonably refused.

The government said many are currently blocked from accessing gigabit-enabled internet because permission was refused or delayed by the property owner who owns the building.

This could leave households facing slow connections even if broadband companies are ready to install upgrades.

Ministers argue the new law will give flat owners more power over basic needs such as internet and help flat owners in more than half a million flats without gigabit connections.

People will be able to request a connection to a gigabit-capable, public electronic communications network capable of providing broadband access services with download speeds of at least 1000 Mbps.

Housing minister Matthew Pennycook said: “This Government has made a clear commitment to ending the feudal tenancy system.

“The Shared Ownership and Leasehold Reform Bill marks the beginning of the end for the rental system that has tarnished the dream of homeownership for many.

“This bill, previously published in draft form, will transform the homeownership experience for millions of homeowners across the country, modernizing property law and delivering a modern housing market.”

UK Telecommunications Secretary Liz Lloyd said: “Fast, reliable broadband shouldn’t be a luxury in modern life. We want everyone to be able to get online, whether it’s to apply for a job, start a business or stay connected with loved ones.

“These new laws will give rental apartment owners a legal right to request internet upgrades for their homes without being overlooked by the property owner, helping every household benefit from the services and opportunities available in the digital age.”

The Shared Ownership and Leasehold Reform Bill will also provide new protections against unfair ground rent charges and make it easier for existing leaseholders to transition into shared ownership.
