Charlie Kirk’s family attends hearing for murder suspect Tyler Robinson
Kirk was addressing a crowd from under a tent on Sept. 10 as part of his America Comeback tour of college campuses, while inviting attendees to discuss him.
While talking about gun violence, gunshots were heard; Kirk slumped sideways.
Chris Bagley, one of four law enforcement witnesses expected to take the stand at the week-long trial, worked on the upper floor of the building and realized from the noise that the sound was coming from a rifle, not a gun.
In court on Monday, he described a chaotic scene of people shouting and running and told the court he was informed by law enforcement that the shooter was in custody.
But he said he found suspicious evidence that led him to believe this might not be the right suspect.
Bagley said he found a screwdriver and gravel on the roof, indicating a sniper, and then watched security footage showing a person climbing down and fleeing the area.
He described the impressive impression the suspect left behind.
“I could see the confusion in the gravel; to me it looked like a sniper site; a person lying face down with elbow, knee and footprint marks; there was someone in sight of where Charlie’s tent was.”
Robinson’s defense attorney, Kathryn Nestor, raised several objections throughout the deposition, asking questions about Kirk’s staffing, planning and oversight on the day of the incident.
Another witness, David Hull, told the court that Kirk was working as an agent with the Utah State Bureau of Investigation at the time of the shooting. He testified that he reviewed security videos from the day of the shooting and saw Robinson “on campus … approximately four times throughout the day.”
Hull testified that Robinson came to the school twice before the attack, then appeared again during the attack and then returned that evening, hours after Kirk’s death.
Prosecutors also played home security camera footage from a neighborhood near campus that showed Robinson parking his gray Dodge, then turning around and driving away.
The trial will continue all week, examining evidence and witnesses in the case to determine whether prosecutors have enough evidence to present to the jury at trial.
