A California college student accused of sexually assaulting a 12-year-old girl in a campus dorm room remains jailed without bail as investigators examine whether additional victims come forward, according to prosecutors.

Menlo College student Andres Manuel Aguilar, 19, is charged with two counts of forcible sexual assault (rape and oral copulation) and one count of furnishing marijuana to a child stemming from the alleged May 5 encounter.

The preliminary hearing continued through Aug. 27 as investigators reviewed information that could lead to additional charges.

“There is nothing new to report regarding the potential second victim in the Aguilar case,” San Mateo County District Attorney Steve Wagstaffe told Fox News Digital. “The case continued until August 27, which gave police more than a month to complete the investigation and for my prosecutor to decide whether the evidence was sufficient to add additional charges for the second victim.”

Prosecutors allege the girl had previously snuck out of her home after meeting Aguilar at a Menlo Park bus stop, according to court notes provided to Fox News Digital by San Francisco affiliate FOX 2. Although the girl told Aguilar she was 17, prosecutors said she admitted she was still a minor.

The two walked to the Safeway store, where prosecutors said they bought beer and rum before returning to Aguilar’s dorm room. Here, investigators allege they drank alcohol and smoked marijuana before sexually assaulting the girl, despite Aguilar repeatedly saying “no.”

Aguilar allegedly became worried about a possible pregnancy and used DoorDash to have the Plan B emergency contraceptive delivered to the girl’s dorm room before giving it to her.

Investigators also say dormitory surveillance video captured Aguilar and the girl entering the girl’s room, then the girl leaving.

Menlo College said in a statement that it takes allegations of criminal conduct seriously and is cooperating with law enforcement, but declined to comment specifically about Aguilar.

“Due to federal and state privacy laws and College policy, Menlo College cannot comment on matters involving identifiable individuals,” the statement said, adding that additional questions should be directed to the Atherton Police Department.

Wagstaffe said investigators encourage anyone who believes they may have been victimized by Aguilar to contact law enforcement.

“If there are other victims out there, we want them to come forward so we can get justice for these types of crimes,” Wagstaffe said.
