Bihar SIR: SC to hear final pleas on October 7, says verdict will apply across nation

On Monday, the Supreme Court was planned for the final hearing of the petitions that challenged the decision to make a special revision of the election roller (SIR) in the Bihar of the Election Commission of India (ECI) on 7 October.

The APEX Court’s counter clearly stated that he would not make fragmented decisions and that a country will come into force. The court also assumed that as a constitutional authority, ECI acted in accordance with the laws and compulsory rules in the ongoing revision exercise in Bihar.

“If we find any illegality in the methodology adopted by ECI at any stage of Bihar Sir, all exercise will be left aside. He said.
“We assume that ECI, a constitutional authority, follows laws and compulsory rules in Bihar Sir Exercise,” he added.

AADHAAR as an Identity Certificate

In the previous hearings, the Court asked ECI to accept Aadhaar as an additional document to create a voter identity in Sir.

However, he stressed that Aadhaar cannot serve as proof of citizenship under the current laws. The bench led the survey body to ensure the reality of AADHAAR presentations and to consider the card as an acceptable 12th identity certificate alongside the previously prescribed 11. Judges, “Nobody wants illegal immigrants in the election roller,” he added, only real citizens should remain on the list, tattoo articles should be excluded, he added. The counter also asked the voters to explain ECI on the indicators served to the authorities who refused to accept AADHAAR cards. Senior lawyer Raqesh Dwivedi, who appeared for the Commission, argued that 99.6% of Bihar’s 7.24 Crore voters have already given valid documents and would make very little practical difference, including Aadhaar.

Requests and Objections Process

The hearing also discussed concerns about the process of demand and objection within the scope of controversial exercise.

Although ECI’s program closed the allegations and objections on September 1, voters and political parties could still file them until the date of candidacy in each election zone. In order to increase access and transparency, the Bihar State Legal Services Authority was directed to deploy illegal volunteers to help voters make their applications.

According to the Commission, between the temporary order of the Supreme Court on August 22 and the last date of September 1, it received 1,34,738 objections for the inclusion and 22,723 requests and excludes. The last election roller is scheduled to be broadcast on September 30th.
