Details of the custody decision have not been made public, but Charity’s lawyer told the Daily Mail that she was unsuccessful in that effort, and at a final hearing on December 2, the judge awarded joint custody.

Three days after they were found dead, a trash diver sifting through trash 15 miles away in Fort Smith found a trash bag full of Charity’s belongings and other special family memorabilia, including photos and a gold necklace engraved with the children’s names.

Beallis later pleaded no contest to a misdemeanor count of criminal mischief and received a suspended sentence. The health board again did not take any action.

Beallis appeared before the board again last year after Charity made domestic violence charges, claiming he assaulted her in front of their children.

In written responses, Beallis denied the allegations, saying the incident arose from a dispute over her phone and emphasized that he never strangled or strangled her.

He later pleaded guilty to third-degree battery and was given a suspended sentence.

No disciplinary action was taken against Beallis when Charity and the children were found dead. State records show his medical license remains active and is set to expire in February 2027.
