Bombay High Court upholds ₹538 cr award to defunct Kochi IPL franchise against BCCI

He also rejected BCCI’s objections in accordance with the Indian partnership law and approved the validity of the arbitration initiated by Rainzvous Sports World (RSW), the owner of Kochi Tuskers Kerala.

The origin of the dispute

BCCI objected to the award at the Supreme Court of Bombay, claiming that the court exceeded the jurisdiction of the judiciary and caused extreme damages that violates the limits of the contract. He also questioned the focus of RSW under the partnership law.
In 2018, the Supreme Court encouraged Kochi Franchise to approach the Supreme Court, which directed BCCI to deposit, and made a temporary stay on the award. La100 crore as a condition for staying continuously.
With the decision of Tuesday, the Supreme Court of Bombay upheld the award and left the option to object to the decision of BCCI.
The first IPL is not a franchise dispute
The Kochi case is one of the few high -risk legal warfares including terminated IPL franchisees.
