A Texas woman has been charged with aggravated assault after throwing a weighted plate at “someone her partner was with.”
The Harris County Police Station 4 Office said the incident occurred at 24 Hour Fitness in Spring, Texas. Press release.
“Upon arrival, deputies learned that a female suspect had assaulted the complainant at the gym after recognizing the complainant as someone her partner was having an affair with,” the press release said.

The charging document reviewed by PEOPLE alleges that Martinez intentionally and knowingly threatened the victim on Tuesday, Jan. 6, by “using and displaying a 25-pound weight plate, a deadly weapon.”
The personal recognizance/surety order reviewed by PEOPLE states that the altercation was captured on cellphone video.
The instruction alleges that Martinez said, “Bitch, I’m going to drop this plate on you,” before throwing the plate. KHOU 11 He reported that the complainant got out of the way in time to avoid injuries.
Precinct 4 Capt. Juan Flores told KHOU 11 the incident did not escalate further because nearby people intervened.
According to KHOU 11, Martinez was arrested Jan. 7 as he was leaving the gym following the confrontation, according to the charging document.

Martinez was arrested and booked into the Harris County Jail and charged with aggravated assault with a deadly weapon, a felony, but was released on a $1,000 bond, according to online records reviewed by PEOPLE.
According to an amended order regarding pretrial supervision and bail conditions reviewed by PEOPLE, “the facts establishing probable cause indicate that alcohol was a factor in the crime.”
The amended order regarding pretrial supervision and bail condition states that Martinez is prohibited from coming within 200 feet of the alleged victim and the gym where the incident occurred.
Martinez was also ordered to submit to drug and alcohol testing by agency personnel, as per the order.
