Colorado e-filing system reportedly requires lawyers to pledge not to aid ICE

Lawyers in Colorado claim the state court’s e-filing system requires them to certify that they will not share personal information to assist ICE or federal immigration enforcement.

Fox News Digital’s review of the website revealed that the page in question was not publicly available and was only accessible by attorneys registered in Colorado.
“I certify under penalty of perjury that I will not use or disclose personally identifiable information as described below. [the act] Obtained from this database for the purpose of investigating, participating in, cooperating with, or assisting in federal immigration enforcement, including the enforcement of civil immigration laws, and pursuant to 8 USC Sec. 1325 or 1326,” the message reads, asking attorneys to “accept” or “decline,” unless required by federal or state law or necessary to comply with a subpoena, warrant or order issued by the court.

“Colorado now requires attorneys in the state to promise not to cooperate with federal authorities in enforcing federal immigration law as a condition of their entry into the court e-filing system,” Speir said in response to X.
Speir added that he does not practice immigration or criminal law and that nothing in his cases would be legal-related. But “he cannot log into the state’s official e-filing system without saluting the Resistance.”

“I now cannot represent my clients, file cases, access cases, file documents in existing cases,” he said, adding he chose the “accept” option “under protest.”
“The bottom line here is that Colorado appears to be illegally encroaching on the private sector He has “deployed lawyers across the state to advance anti-federal protection policies,” Speir told Fox News Digital later Friday.
Attorney and former law professor Matt Barber added to X that the oath the state expects from lawyers is “indefensible.”
