Hawaii real estate investor denies improper use of Shohei Ohtani’s likeness in lawsuit

Honolulu (AP) – For a Hawaii real estate investor and broker who sued Shohei Ohtani, lawyers and agents refused to use their uniqueness for a development project inappropriate and claimed that the agent was trying to deflect the crime for the cost -effectiveness of the player’s home.
Ohtani and Nez Balelo from Caa Baseball On August 8, a lawsuit was filed for the first circuit at the Hawaii Circuit Court Developer Kevin J. Hayes SR, Real Estate broker Tomoko Matsumoto, West Point Investment Corp. and by Estath property owners. Ohtani and Balelo accused Big Island’s greedy intervention and unjust enrichment affecting the development of $ 240 million on the coast of the greedy pill of Big Island, which was allegedly abused.

Hayes and Matsumoto fell from the development agreement by Kingsbarn Realty Capital, the majority of the joint venture.
The amended complaint added the Creative Artists Agency and Caa Sports as the defendants.
The complaint said, “Balelo and Caa tried to mislead Hayes by making a scapegoat for the cost excesses at Otani’s house – the overflow of the defendants’ own decisions.” He said.
Josh Schiller said, “The allegations that we clarified them are never a violation of the approval agreement, especially on the website introducing this project, the video, Balelo and CAA, and Ohtani, Mark Daulton, said that they were not aware of another consultant and never object.

In a dismissal movement opened on September 14Ohtani and Balelo lawyers, “plaintiffs Ohtani’s name and photograph, plaintiffs’ own side project development of a website has revealed traffic to a website,” he said.
“This is a desperate attempt to avoid rejecting a meaningless complaint, and as we have previously said, the countless failures of the plaintiffs, and the explicit abuse of the rights of Shohei Ohtani, as we have previously said. “Nez Balelo has always given priority to Mr. Ohtani’s best interests, including protecting his name, image and similarity from unauthorized use.”
For Hayes and the plaintiffs, lawyers claimed that they informed Balelo and Caa.
“Before the website revived, Hayes presented a link to the entire site, including the promotional aspects. He continued:” Baleli suddenly remained online without any significant changes before objection and threatening it – arming the problem to create an excuse for another series of demands and concessions. “

“The sudden request that Kingsbarn terminated the plaintiffs was a retaliation against Hayes to resist the continuous and wrong demands of Balelo and (Ohtani),” he added. “The defendants also calculated that with the abolition of the plaintiffs, they could get more easily financial privileges than the project and that they could enrich themselves at the expense of the plaintiffs.”
