Illegal immigrant indicted in deadly Arizona crash that killed her daughter

An illegal immigrant mother who ICE agents arrested after a fatal Arizona crash that killed her nine-year-old daughter has been charged after toxicology results allegedly showed methamphetamine and marijuana in her system, according to Arizona prosecutors.
Brenda Rivera Estrada, 30, has been charged in connection with the April 12 crash on northbound Interstate 17 near Cactus Road in Phoenix, Maricopa County Prosecutor Rachel Mitchell announced Monday.
Officials said Rivera Estrada crashed into her SUV and killed her daughter, who was thrown from the vehicle. Three other children in the SUV (an 11-year-old boy, a 3-year-old boy and a one-year-old girl) suffered minor injuries.
Fox News Digital previously reported that Rivera Estrada’s daughter was allegedly sharing her seatbelt with her brother when she was ejected during the rollover crash.

Arizona Department of Public Safety troopers suspected Rivera Estrada was in impaired health after they reportedly smelled marijuana at the scene. Toxicology results later showed Rivera Estrada tested positive for both marijuana and methamphetamine, prosecutors said.
A prosecutor had previously said that “the suspect chose to get into a vehicle allegedly under the influence of marijuana.” he told Fox 10 Phoenix. “Multiple witnesses testified he was driving over the posted speed limit of 65.”
A Maricopa County grand jury indicted Rivera Estrada on one count of involuntary manslaughter, three counts of endangerment, one count of possession or use of dangerous drugs and one count of possession or use of drug paraphernalia.

The manslaughter charge is classified as a Class Two Dangerous Felony.
Prosecutors said Rivera Estrada was transferred from ICE custody to the Maricopa County Jail following the indictment and was being held on $250,000 cash bond.
The indictment comes weeks after ICE confirmed that Rivera Estrada, a Mexican national, was released from local custody before federal immigration authorities detained him in an immigration detention facility while prosecutors awaited toxicology and crash reconstruction results.

ICE officials previously told Fox News Digital that Rivera Estrada entered the U.S. in February 2009 through Nogales, Arizona, as a nonimmigrant border crosser with a permit to remain in the country for up to 30 days. He remained in the United States beyond that period, in violation of federal immigration law, authorities said.
Maricopa County District Attorney Rachel Mitchell has previously defended the delay in filing charges, saying the case requires additional investigation before prosecutors can move forward.
“I’ve said this many times: We have one chance to do this right,” Mitchell said last week. “In complex cases like this, it routinely takes time to gather the evidence needed to prove a case beyond a reasonable doubt.”

Alejandro Almeida, Deputy Director of the ICE Enforcement and Removal Operations Phoenix Field Office, previously said Rivera Estrada’s arrest highlights the importance of ICE’s Criminal Alien Program.
“The identification and arrest of Brenda Liliana Rivera-Estrada by ICE underscores the importance of the Criminal Aliens Program and highlights the public safety efforts conducted by officers in Enforcement and Deportation Operations,” Almeida said in a statement to Fox News Digital. he said.

Rivera Estrada will remain in custody until further court proceedings.
