Delhi HC Quashes NHAI’s CLAT-PG Lawyer Recruitment Notification

New Delhi: On Wednesday, the Delhi Supreme Court put aside a notification of the Indian National Highways Authority (NHAI), which made Clat-PG’s scores a basis for the recruitment of lawyers.
A Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela allowed a petition that challenged the August 11 NHAI notification.
While pronounced the bench decision, “the petition is allowed. As a result, the recruitment criteria given in the notification are broken.” He said.

The court’s decision made an objection that challenged a notification of NHAI, which has made Clat-PG’s scores a basis for the recruitment of lawyers.
On September 18, the court reported that there was no ‘justification’ behind the process.
According to a petition opened by Shannu Bahgel, a lawyer, the joint law acceptance test in 2022 (Gralat-PG) cannot form the basis of public employment to assess the value of the relevant candidates who hold a degree of LLB.
On behalf of the petition, it is suggested that the election purpose is not to receive a master’s degree in law, but to provide services for a law expert.
The petition does not seem like a reasonable or rational bond between objects trying to be obtained and the basis of the preparation of merit for such a choice. ” He said.
The bench had previously observed that the logic of the Clat-PG exam was to evaluate the merit of maintaining higher studies, not for public employment.
NHAI adviser said that the authority tested the scores and tested the legal intelligence of a candidate.
The only reason was that the Clat scores were a reasonable criterion to understand, although the lawyer was based on the Clat scores of the election, he added that the authority gave priority to experience.
The petition holder asked NHAI’s August 11 notification, 44 young professional candidates based on the scores obtained in Clat 2022 and the subsequent pressure of the graduate law acceptance test.
He argued that CLAT-PG scores could not form the election basis for public employment, and that the notification was “arbitrary and unreasonable” for restricting public employment for candidates who appear for CLAT-PG for only 2022.
“Recruitment is limited to the candidates who appear only in Clat 2022 and the next PG, ignores all other legal graduates, and applies defenders who are full qualified.
