Explainer-Can Trump invalidate Biden actions recorded by autopen?

WILMINGTON, Delaware, Dec 11 (Reuters) – U.S. President Donald Trump claimed, without evidence, that some of the actions former President Joe Biden signed using automated signatures, including appointments to the Federal Reserve Board, were invalid.

Below is a look at the controversy and legality of the device.

WHAT IS OTOPEN?

It is a mechanical device that copies a signature with a pen or other writing device and is used by government officials, celebrities, business leaders, and members of Congress. This allows them to create large volumes of personalized correspondence without having to sign their name over and over again.

Thomas Jefferson, who became US president in 1801, used an early form of automatic writing device to create multiple letters simultaneously in his own handwriting.

Presidents have used the automatic pen to add signatures to documents for decades. During a 2011 trip to France, Barack Obama became the first president to use it to sign legislation to extend expiring provisions of the Patriot Act.

WHAT DID TRUMP SAY ABOUT BIDEN’S USE OF AUTOPEN?

Since returning to the White House, Trump has focused on Biden’s use of the auto-open feature to highlight questions about his predecessor’s health and competence.

In June, a Justice Department official told staff that the agency was investigating pardons and pardons Biden granted to family members, political allies and death row inmates in the final days of his presidency. The investigation focused on whether others used Biden’s automated signature without approval.

Biden told the New York Times that he instructed his staff to use the automatic shutdown because of the large number of amnesty orders.

Although no evidence emerged that Biden intended to issue the orders, Trump said earlier this month that he would end the automatically saved Biden pardons. Trump also said Biden used the automatic declaration to appoint Federal Reserve governors.

HAS THE AUTOPEN GIVEAWAY REVIEW BEEN USED IN THE PAST?

During President George W. Bush’s administration, Secretary of Defense Donald Rumsfeld acknowledged using autosignature to sign letters to families of soldiers killed in battle. When the incident came to light, he promised to sign the letters himself.

Republicans criticized Obama’s use of autosignature to sign the Patriot Act into law in 2011 and said it could be challenged in court, although no lawsuits appear to have been filed.

WHAT IS THE LAW GOVERNING THE USE OF AUTOPEN?

The Constitution says that if a president signs a bill passed by Congress, he “shall sign it.”

In 2005, the Department of Justice’s Office of Legal Counsel offered an authoritative review of the meaning of the word “sign” and found that it was widely understood by the founding fathers that a person could consent to an agreement by directing a subordinate to apply that person’s signature or seal. The OLC determined that what is important is that the signature reflects the person’s intent, not the person holding the pen.

In 2001, a group of businesses challenged President Bill Clinton’s appointment of members to the International Trade Commission, and this was recorded using automatic registration. Although the device was only a small part of the case, the court found that Clinton had clearly communicated her desire to make an appointment and that the automatic shutdown had no impact on the legality of the appointment.

CAN TRUMP VOID THE BIDEN AMNESTY AND FED’S APPOINTMENTS?

According to legal experts, there is no legally prescribed format for granting pardons, and the use of automatic foreclosure does not invalidate pardons.

The pardon could possibly be invalidated if it turns out that a Biden aide used ⁠autopen without permission and that Biden did not intend to issue the pardon, legal experts say.

It seems even less likely that Trump will object to the appointment of Federal Reserve chairmen, legal experts say. Governors are nominated by the president and confirmed by the U.S. Senate, making it difficult to argue that the process occurred without Biden’s knowledge.
