Federal appeals court dismisses DOJ complaint against Judge Boasberg

A federal appeals court dismissed the Justice Department’s misconduct complaint against U.S. District Judge James Boasberg, according to court documents released this week.
Jeffrey S. Sutton, chief judge of the Sixth Circuit Court of Appeals, dismissed the complaint on Dec. 19, but news of the decision only broke this weekend. The Justice Department alleged misconduct on the grounds that Boasberg made comments at a judicial conference that said the Trump administration would ignore federal court orders, leading to a “constitutional crisis.”
His comments at the conference came just days before Boasberg issued an order blocking deportation flights.
Sutton argued that the government did not provide evidence of Boasberg’s comments or sufficient context surrounding them.

“Repetition of unvarnished allegations without attribution to a source does not substantiate them. Repetition of unsubstantiated statements is rarely the basis for a valid misconduct complaint,” Sutton wrote in his decision. he said.
News of the decision comes just days after the White House confirmed the Senate Judiciary Committee’s support for an impeachment inquiry into Boasberg and another judge Republicans describe as an activist.
“The left-wing activist judges were completely fraudulent,” a White House official told Fox News Digital. “They are undermining the rule of law to serve their own radical agenda. This must be stopped. The White House is fully embracing the impeachment effort.”

The White House official said that President Donald Trump should be able to “lawfully implement the agenda for which the American people elected him” and argued that judges who repeatedly make partisan decisions are abusing their office and losing their claim to impartiality.
Boasberg has become a prime target of Republicans over a series of decisions tied to Trump-era immigration policies, including cases about transferring immigrants to El Salvador and other countries rather than detaining them in the United States.

More recently, there was a new backlash from the GOP after reports emerged that former special counsel Jack Smith had approved arrest warrants related to the “Arctic Frost” investigation that allowed investigators to seize phone records linked to some Republican lawmakers.

He first faced articles of impeachment in March 2025 for blocking the administration from deporting certain illegal immigrants under the Alien Enemies Act, and again in November for the Arctic Frost decision.
