Federal judge raises concerns Trump administration not complying with ICE

A federal judge in Colorado questioned whether the Trump administration was complying with his order banning ICE arrests in the state, according to Colorado Public Radio.
Senior U.S. District Judge R. Brooke Jackson, appointed by former President Barack Obama, said at a hearing Wednesday that the Justice Department failed to comply with a November injunction requiring flight risk assessments and warrants before detaining people, CPR News reported.
“These things shouldn’t be this hard,” Jackson said. CPR.
“Policy [Immigration and Customs Enforcement] It was a good policy and all they have to do is follow their policy and we’re good,” he added. “But for whatever reason they insisted on not accepting it… and here we sit today. I don’t understand this.”

Jackson filed for a preliminary injunction on Nov. 25, 2025, in the class-action lawsuit filed by the ACLU of Colorado and common law groups, according to a press release from the organization. The lawsuit alleged that ICE agents made arrests without judicial warrant and without determining whether the individuals were both present unlawfully and likely to escape before a warrant was issued.
The case initially focused on four plaintiffs, including University of Utah student Caroline Dias Goncalves, who was brought to the United States from Brazil as a child. According to the ACLU. The organization said he was detained following a traffic stop and held for more than two weeks before being released.
Under the order, ICE officers cannot make warrantless arrests unless they have valid reason to believe a person has violated immigration law and is likely to flee before a warrant is issued. While providing assistance, Jackson said that although ICE has the authority to enforce immigration laws, “in carrying out those responsibilities, [ICE agents] According to the ACLU, they have to follow the law.

At Wednesday’s hearing, ACLU lawyers argued that arrest records turned over to them showed continued violations of the measure, CPR reported.
“They’re actually detaining and detaining people before searching headquarters. The arrests are being made without any warrant,” said Tim Macdonald, legal director of the ACLU of Colorado, according to CPR. “All I-213s we submit indicate continued violations of your order.”
Macdonald added that the reports reviewed so far do not reflect documented flight risk assessments or judicial warrants.
“We are seeing uniform noncompliance,” he said, according to CPR.
Assistant U.S. Attorney Brad Leneis acknowledged that some arrest forms did not fully reflect the terms outlined in the court order.

“Looking at these I-213s, they do not provide the description of the arrest required by the court order,” Leneis said, according to CPR.

But Leneis told the judge that the government had taken steps to implement the new procedures since December and argued that compliance had increased.
“We started from scratch, we had a lot to fulfill,” he said, according to CPR. “We think the numbers are better now than they were in December.”
