The “H-1B and L-1 Visa Reform Law” aims to make the fraud and abuse of the visa program, which the Congress says it replaces American workers.
Senator Durbin, “Thousands of American workers dismissed thousands of visa in depressive wages and non -standard working conditions sent thousands of visa requests.”
Legislation imposes a series of new restrictions:
Priority for STEM degrees: H-1B Visa Distribution System will give priority to employees with STEM degrees (science, technology, engineering and mathematics).
More meticulous wage and recruitment standards: Employers are subject to more strict wage and recruitment requirements for wage abuse.
L-1 Visa boundaries: Legislation, wage and displacement guards and restricting the displacement of employees, by large multinational companies to bring existing workers to the United States employed to bring the L-1 visa system.
Why were Indian workers hit hard?
This year, in another action by the administration this year, it will disproportionately affect Indian citizens who have occupied about 71% of all H-1B visa buyers.
Although fresh lottery revision is designed to benefit higher wage workers, some analyzes warn young, who generally work in lower H-1B payment layers than India and China, will harm lower-level professionals.
Nicole Gunara, the main immigrant lawyer of the manifest Law, said changes will increase compliance and H-1B recruitment costs, especially for contracted personnel or lower wage groups.
Uncertainty despite the legislative pressure
The action represents the latest step in the attempt to create harder migration standards of the Trump administration, and the Trade Secretary Howard Lutnick states that recently announced additional changes in the H-1B process until February 2026.
Even with two -party support, immigration lawyers recommend that the final effect of the bill is early to describe. He referred to the past when only 5% of the immigration invoices before the Congress passed into the law and implied a long and unpredictable journey for proposed changes.
