HC sets aside acquittal, imposes ₹1-lakh fine on convict

The Supreme Court of Kerala put aside the acquittal order and fined the convict on charges of appealing two penalties before a session court.

Among them, one resulted in the approval of the sentence, the other was acquitted. PV Kunhikrishnan, a single justice bench, observed that lawyers, plaintiffs and the court registry should be cautious about too many appeals, revisions and other proceedings arising from the same issue.

One session court confirmed his conviction in 2012, then applied for another appeal through another lawyer and was acquitted by the court in 2016. The incident appeared years later after years when a residence judgment noted abnormality in the proceedings and sent a letter to the Supreme Court. The Supreme Court launched Suo Motu transactions against the convicts.
