House panel summons Fairfax sheriff and prosecutor over sanctuary policies

House Republicans are firing two top Fairfax County law enforcement officials, including a Soros-backed prosecutor, after violent crimes involving illegal immigrants released from custody intensified federal scrutiny of the county’s sanctuary-style policies.

Fairfax County Sheriff Stacey Ann Kincaid and Fairfax Commonwealth’s Attorney Steven Descano have been invited to voluntarily testify at an upcoming Immigration, Security and Enforcement Subcommittee hearing titled “Fairfax County Virginia – Dangerous Consequences of Sanctuary City Policies.”

Both are elected Democrats, and Descano’s campaigns received more than $700,000 in funding from organizations backed by far-left Hungarian-American billionaire George Soros. Law Enforcement Legal Defense Funda pro-police group.

Descano and Kincaid, Committee Chairman Jim Jordan, R-Ohio, and Subcommittee Chairman Tom McClintock, R-Calif. They received nearly identical letters signed by Fox News Digital, which were also obtained by Fox News Digital.

“The hearing will examine how state and local policies that prohibit cooperation with federal immigration authorities harm public safety,” Jordan and McClintock wrote.

“Your testimony will assist the Committee and Subcommittee in developing legislative reforms to address sanctuary jurisdictions.”

Fairfax officials have until Monday to confirm they will attend the April 15 hearing at the Rayburn House Office Building on Capitol Hill.

Descano has a history of dropping charges against illegal immigrants, often with prior criminal records, including Marvin Morales-Ortez, a Salvadoran national accused of killing a Virginia man ambushed on a hiking trail.

Jordan and McClintock had previously written to Descano about their concerns about this case, stating that his policies “prioritize illegal aliens over American citizens and threaten public safety.”

They said Kincaid released Morales-Ortez on Dec. 16, despite his possible ties to MS-13, after Descano’s office refused to pursue prosecution in a malicious wounding case from Sept. 12.

“Although Morales-Ortez was an ICE detainee, your office refused to briefly detain him until ICE arrested him and did not even inform ICE of his imminent release,” lawmakers wrote to Kincaid at the time.

“A day later, Morales-Ortez allegedly killed a man in Reston, Virginia, and is now charged with second-degree murder. But even now, you continue to defend your failed sanctuary policies and refuse to take responsibility for their consequences,” the lawmakers wrote in the letter. Washington’s ABC affiliate.

The publication also reported that the Fairfax County board, led by Chairman Jeffrey McKay, D-Franconia, also prohibited the Fairfax County Police Department from cooperating with ICE.

Media reporter Nick Minock later obtained a transcript of Morales-Ortez’s preliminary hearing in which Descano’s office argued that Morales-Ortez was present when Jose Guillen Mejia was killed and ambushed while pursuing the man.

Shortly after his release, Morales-Ortez allegedly went to a home on Fan Shell Court in Reston, Virginia, near John F. Dulles International Airport and allegedly shot a man inside.

This chain of events angered the Trump administration, with then-DHS Deputy Secretary Tricia McLaughlin stating: “Fairfax County politicians [who] The coercive policies that released this illegal alien from prison “have blood on their hands.”

More recently, the family of Stephanie Minter, 41, who was stabbed to death at a Fairfax bus stop by an illegal immigrant with a long criminal record, called for Descano’s removal.

Sierra Leonean citizen Abdul Jalloh was charged with second-degree murder, and Descano released him despite being warned that he had been arrested 30 times before. Jalloh was ordered deported during the Biden administration but was never deported.

According to Fox & Friends, a police official in Mount Vernon emailed Descano’s office with concerns about Jalloh being released again.

Given the heavy Democratic tilt of Fairfax, Virginia’s largest county by population, and one county official sought to include in at least five newly elected congressional districts, Descano and Kincaid were strongly supported by voters in each election.

While Republicans have fielded no challengers for either candidate in 2023, Descano’s only objection came from fellow Democrat Ed Nuttall, whose initial bid was reportedly boosted by victims’ rights advocates.

Nuttall also launched a write-in challenge at that year’s general election but lost. Kincaid was first elected in 2013.

Fairfax Democrats expelled Nuttall from their party during that write-in bid after he attended a Brain Foundation fundraiser with Fairfax’s only Republican board member, Pat Herrity of Springfield, and a Republican board candidate named Keith Elliott of Sully. According to FairfaxNow.

Herrity is the son of the late Mayor Jack Herrity, a Republican known as “Mr. Fairfax” in the 1980s, when the county was much more conservative.

Fox News Digital has reached out to Descano and Kincaid’s offices for comment.
