Mamdani says Bronx landlord case sets new legal precedent for NYC

New York City Mayor Zohran Mamdani on Thursday cited the case as a new template for City Hall to crack down on property owners who fail to fix violations, citing a Bronx Supreme Court decision against Bronx homeowner Seth Miller that he said has already awarded more than $2.1 million.

Speaking at Bronx Borough Hall, Mamdani said the court found that “years of uncorrected code violations at 919 Prospect Avenue have plagued the public” and ordered fines of “$1,000 per day” for violations dating back to April 21, 2019, adding that those fines “have so far totaled more than $2.1 million” and “will continue to accumulate” if repairs are not made.

“Since your landlord, a repeat offender on New York City’s annual Worst Landlord Watch List, purchased the property in 2011, your tenants have faced an endless stream of violations that have harmed their health, safety and well-being,” he said. “We’re talking mouse, rat and cockroach infestations, leaky pipes, collapsed ceilings, black mold and lead paint. Frankly, the list of abuses and failures goes on and on.”

“This is a landmark victory,” he said, “and is the first time the court has imposed the maximum fine allowed on a homeowner under the Nuisance Abatement Act.”

He also warned other property owners: “If you don’t change your ways, we now have a strong precedent where we can take the same type of legal action against you.”

Mamdani’s corporate counsel, Steven Banks, declined to say how the city would enforce compliance if the landlord resorted to bankruptcy tactics.

“There’s more than one way to move forward. I’ve always learned [that] “When you’re dealing with someone like this landlord, it’s best not to telegraph exactly what we’re going to do,” Banks said. “But rest assured: we will be ready.”

The mayor said the city “allocated more than $85 million from our preliminary budget to add 200 new attorneys and 100 support staff to our Legal Department,” arguing that compliance, not revenue, was the goal.

This pressure further reinforces Mamdani’s early stance of targeting homeowners and promising aggressive legal intervention.

“We will make sure the 311 breach is resolved,” Mamdani promised at his inauguration ceremony on Jan. 1.

“Today marks the beginning of a new era for New York City,” Mamdani said. “Today is opening day. It’s also the day the rent comes due.”

During the day one action plan, Mamdani announced an executive order creating a LIFT task force, or a land inventory study designed to strengthen city-owned land and boost housing development. He said the task force will review city-owned properties and identify areas suitable for housing development by July 1 at the latest.

He also announced the SPEED task force, which Mamdani said stands for Streamlining Procedures to Accelerate Equitable Development. He said the task force will work to remove permitting hurdles that slow housing construction.

Both task forces will be overseen by Deputy Mayor for Housing and Planning Lila Joseph, he said.

“These are comprehensive measures, but they are just the beginning of a comprehensive effort to champion the tenants’ cause,” Mamdani said.

Landlord groups have attacked Mamdani’s tenant protection chief Cea Weaver, a longtime housing activist and member of the Democratic Socialists of America (DSA), for her past comments associating homeownership with “White supremacy,” calling them “racist” and evidence of hostility toward property owners.

Speaking about housing policy and equity in a DSA video released in March 2021, Weaver said: “For centuries we’ve treated property not really as a collective good, but as an individualized good, and as we move towards treating it as a collective good and towards a model of shared equity, it’s going to require us to think differently about this.”

“Families, particularly White families, but also some POC families who are homeowners, will have a different relationship with property than we have now,” he added.
