Allahabad High Court stays EOW probe against 558 aided madrassas in Uttar Pradesh

At the beginning of this week, the Supreme Court of Allahabad conducted an investigation by the Economic Crime Wing (EW) against the 558 -supported madrasah in Uttar Pradesh.

The investigation allegedly violating human rights in Medrasas was carried out by Eow on the instructions of the National Human Rights Commission, which was involved in a complaint by a person named Mohammad Talha Ansari.

Earlier this year, Islamic educational institutions challenged NHRC’s instructions and investigation.

Saral Srivastava and Amitabh Kumar Rai Justice A bench left the investigation by EOW on 22 September.

In front of the Court, the Petition stated that the functions of the Commission were specifically numbered in accordance with the 12th part of the Law on the Protection of Human Rights of 1993 and clearly state that the 36 (2) section of the Law cannot question any issue after the end of one year, which is the violation of human rights of the Commission.

The petition is also not possible to determine whether the complaint is silent in terms of the alleged violation of human rights and that the averages made here are uncertain and did not disclose any date, whether the complaint was filed within one year from the alleged violation date.

Therefore, it is stated that the entire exercise undertaken by the Commission is without judicial authority.
