The Department of Homeland Security (DHS) and the Department of Transportation (DOT) said the suspect, 54-year-old Yisong Huang, entered the country illegally from Mexico in 2023. Officials added that Huang, who reportedly could not speak English, was released under the Biden administration and provided work permit documents.
Transport Minister Sean Duffy, who has previously warned about illegal immigrants obtaining commercial driver’s licenses (CDLs), said this incident represented another example.

Investigators reported that Huang was “distracted by a video he saw on his phone” while driving an empty bus on a major highway on Dec. 9.
New York Post It reported that Huang operated a tour bus. The man allegedly rear-ended a tractor-trailer, triggering a chain-reaction crash that injured two people and killed Kerry Smith, an American citizen, according to authorities.
Huang was later arrested and charged with vehicular manslaughter, according to the Putnam County Sheriff’s Office.
Huang Entered the USA illegally two years ago, according to DHS. He admitted to Border Patrol agents that he was a Chinese citizen, but was later released and given work permits and a Social Security card, authorities said. This, the agency alleges, allowed Huang to obtain a Class B CDL; This process ultimately led to a fatal multi-vehicle crash.

New York State The Department of Motor Vehicles told Fox News Digital on Wednesday that Huang’s license was issued on April 11, 2025, and that he submitted all required federal documentation to obtain a license. The agency said its documents establish a “legal entity” through July 15, 2029.

According to Duffy, the state DMV “routinely issues CDLs illegally to foreign drivers. The federal audit revealed a shocking 53 percent failure rate in sampled records; collapse in governance New York’s CDL program.”

Every CDL we issue is subject to verification of the applicant’s legal status through federally issued documents reviewed in accordance with federal regulations.
