Kerala High Court upholds ban on single-use plastic items

The Supreme Court of Kerala approved the orders of the state government in 2019 by prohibiting a prohibition for the production, storage, transport and sale of disposable plastic items in the province since 1 January 2020.

A justice bench Viju Abraham approved the orders while rejecting the petitions that challenged them by Kerala Plastic Producers Association.

Plastic transport bags, plastic layers, plates, plates, dishes, spoons, forks, pipettes and bowls of thick thickness between banned plastic products, pet bottles of less than 300 ml, flags and woven bags. The petition holders questioned the state government’s authority to give orders without the corresponding central rules.

The state argued that decisions were given within the scope of the Environmental Protection Law, which is a power approved by the Supreme Court. On the challenging fines imposed on them for the illegal production and storage of the disposable plastic, the Supreme Court said, “The petitions solve their solutions in appropriate transactions”.

The court also added that the government is dependent on the task to implement the rules of the government’s instructions in government decisions and the rules framed by the center.
