Lucy Letby will not face further criminal charges

The CPS said the decision followed an investigation into new allegations of murder and attempted murder in 2025

Lucy Letby will not face any new charges for infant deaths and collapses at the hospitals where she worked.

The Crown Prosecution Service (CPS) said it had examined evidence into allegations of murder and attempted murder of nine children at the Countess of Chester Hospital and Liverpool Women’s Hospital, but “the evidentiary test was not met in any of these cases”.

Presenting the evidence, Cheshire Police said the verdict was “not the outcome we expected”.

Former nurse Letby was sentenced to 15 life sentences for murdering seven babies between June 2015 and June 2016 and attempting to kill a further seven by making two attempts on one of her victims.

Frank Ferguson, of the CPS, said they had written to the families concerned and would propose meetings to explain the decision.

The head of the CPS’s special crime and counter-terrorism section said: “In July 2025 we received a dossier of evidence from Cheshire Constabulary asking us to consider further allegations against Lucy Letby, 36, relating to the deaths and non-fatal collapses of babies at the Countess of Chester Hospital and Liverpool Women’s Hospital.

“After a thorough review of this evidence, we have determined that no criminal charges should be filed in relation to these further allegations.

“The Crown Prosecution Service assessed charges of murder and attempted murder in relation to the two deceased babies, and attempted murder in relation to the seven surviving babies.

“We conclude that the evidentiary test was not met in any of these cases.”

Cheshire Police said the decision not to prosecute was “not the outcome we expected”.

Police said they were “confident” they had sufficient evidence.

‘Respect privacy’

“We submitted a file for a decision regarding nine babies, nine for attempted murder and two for murder.

“We believed the evidence submitted met the CPS charging standard.”

He added: “The CPS disagreed and we must respect the decision made despite our representations.”

“There will be those who think this is news worth celebrating. We do not share this view and ask people to respect the privacy and feelings of the families involved.”

It was stated that he was “deeply grateful” to the experts and witnesses who contributed to the investigation.

“Their input has been invaluable in answering many difficult questions on behalf of families.”
