Mehul Choksi Extradition: India Assures Belgium On Detention Conditions Amid Rights Concerns | India News

The Ministry of Interior of the Indian Government (MHA) will be detained if the authorized Belgian judicial officials, who detailed the conditions requested by the Ministry of Justice and the Belgian Kingdom and the Bank’s fraud case, will be detained if sent back from Belgium to India.
The guarantees approved by MHA by consultation with the Maharashtra government and the prison officials have set certain materials, medical and procedural measures aimed at addressing human rights concerns brought to the agenda in return transactions.
Security was presented in connection with the request of surrender in India’s Central Investigation Bureau (CBI). Choksi is accused of under various provisions, including the chapter 120-b (penalty conspiracy), chapter 409, 420, 477a and the Indian Penal Code (IPC) and 201. Corruption Law (POCA), 1988.

The Indian government aims to provide operational guarantees to the Belgian Forensic authorities that they will comply with the minimum standards accepted by the Belgian Forensic authorities by elaborating their specific facility, occupancy limits, medical provisions and surveillance mechanisms.
The Ministry of Interior (MHA), Choksi’nin detained as a facility for the detainees of the Arthur Road prison in Mumbai Barrack No. 12 said. The letter summarizes several binding guarantee to ensure human and honorable treatment. Each prisoner shall be provided by the Council of Europe Council of the Council of Europe at least three square meters, excluding furniture in accordance with the norms determined by the torture prevention committee (CPT). The barrack number 12 has a maximum operating capacity of six people and two cells defined during reporting were empty.
According to the letter, the sleep arrangements in the Barracks include a clean, thick cotton mat (defined as bed), pillow, bed page and blanket. Metal or wooden beds can be provided based on medical advice or court orders. The cells are equipped with grilled windows, ventilators and ceiling fans and are subject to routine cleaning, pest control and continuous municipal drinking water supply. Sanitation facilities include a flush toilet and washing basin and bathroom opportunities in the cell.
In the letter, “the prisoners’ receivables three times a day, accommodation for special diet needs subject to medical approvals. A prison canteen and fruit and basic snacks are also allowed. Daily outdoor exercise in the courtyard courtyard is allowed and closed recreation, board of directors and daily Badminton.
Medical care is provided through the 24×7 facility assigned by six medical officers, nurses, pharmacists and laboratory support. There is a 20 -bed prison hospital with YBU capability and urgent applications can be made to Sir JJ Hospital Group, which is about three kilometers away. Prisoners may also request special medical care at their own cost. MHA guarantees that Choksi will take into account the pre -existing medical reports and that the necessary equipment and therapies will be provided free of charge based on medical advice.
The Barrack No. 12 is separated from the main prison complex and constantly monitored via CCTV, prison staff. It hosts non -violent prisoners such as economic or white -collar criminals and does not contain excessive crowds, violence or extortion. Legal access is guaranteed with lawyers (except Sundays and public holidays) with daily meetings, weekly visits from blood relatives and access to telephone and video conference facilities.
MHA described assurance as a sovereign commitment in consultation with the state government and prison officials, and claimed that it could not be invalid by administrative or judicial authority in accordance with Indian law.
Among the surveillance mechanisms in the Winter are inspections and judicial control by the Prison Administration, National and State Human Rights Commissions (NHRC/SHRC). Complaints and healing action channels are also summarized in confirmed ill -treatment.
Training is emphasized for prison staff, a six -month first program and periodic refreshing courses. They receive one -year intense induction and additional training for prison officers. Measures such as yoga and meditation are included in the personnel training to promote restriction and control.
This comprehensive framework aims at the Belgian courts in assessing whether Choksi’s detention conditions can be encountered in India, especially those who aim to prevent torture or inhuman or humiliating treatment. These guarantees are widely used in return transactions to eliminate concerns within the scope of Article 3 of the European Convention on Human Rights.
Later, Belgian courts, including the indictment chambers in Antwerp, which is reported to be forwarded, will assess these guarantees as well as their legal and evidence requirements for surrender. If the guarantees are considered sufficient and all legal conditions are fulfilled for the return, the Choksi can be delivered to India to be tried in the CBI case. The terms specified in the MHA letter will remain at the center of any judicial assessment of possible custody treatment.
Choksi was arrested in Belgium in April after an official request of the Indian officials. He and his nephew Nirav Modi, the first defendant in the PNB fraud case with fraudulent operations.
