An asylum seeker was allowed to stay in England because he does not want to shave his beard. The anonymous immigrant from Tajikistan won an appeal application after arguing that he would have to shave his beard if he was deported.
He also said he could torture if his home office returned him to Tajikistan. His claim was initially rejected, but a court has now decided that he should receive international protection in the UK because of his face hair.
As reported TelegramHundreds of thousands of men have been arrested for having a beard in Tajikistan in the last decade. The government officially banned men from radicalization and participation in Islamic terrorist groups.
The man who is given anonymity is the latest immigrant using the Human Rights Law to stop their deportation. After his claim was initially rejected by a judge, he claimed that the court would correctly evaluate whether he would shave his beard because of the “fear of persecution”.
Deputy Court Deputy Court Parminer Saini, “(First Stage Court) Judge (Tajik Adam) ‘social pressures’ because of the beard or ‘fear of persecution’ because of the shaving of his beard did not evaluate.
“We see that this represents inadequate and incomplete reasoning in relation to the basic issue of the cause. [Tajik man] He is willing to shave his beard when he returns to Tajikistan.
He continued: “If he wears a beard of religious belief, but to comply with the reasons for securing his safety, he may have the right to international protection.
“However, wearing a beard for social or other pressures is not a belief act, not because of the risk of persecution, but then it may not be refugees.”
The authority added: “We also note that for the judge (Tajik Man), it cannot be evaluated by referring to the background material in front of the objective risk.
“(His lawyer) took us to a few examples … This is widespread, arbitrary arrest, which pointed to torture and ill -treatment, to be ordinary, forcibly shaving and fingerprints and so on.
“For this reason, this background material examples before the judge are under the risk of return (Tajik Man) whether or not to be forced to shave because of fear and should be informed.”
