Setka stepped down as boss of the construction union in 2024 after facing multiple allegations of misconduct linked to his activities within the CFMEU. He was elected to lead the Victoria branch in 2012.

Setka was found guilty in 2019 of using a carriage service to harass his ex-wife Emma Walters and violating a court order.
The abuse included calling him 25 times in one night and sending him 45 text messages, including calling him a “traitorous Aussie f—en c—“.
He was fined $1,000, placed on good behavior bail and ordered to complete a men’s behavior modification program.
In 2023, Walters was convicted of recklessness by threatening to kill Setka but escaped conviction.
