Family files lawsuit after man dies following encounter with Joliet police

Joliet police officers are facing a new lawsuit and are accused of using excessive force.
Body camera video shown David Malito, 39, was fighting with officers at a gas station last Christmas before his death.

Police said Malito was acting erratically. He was arrested and had a police officer’s knee on his back.
Malito died shortly after.
Police said Malito had drugs in his system and died of an overdose.

The Will County State’s Attorney’s Office cleared the officers of any wrongdoing.
Malito’s family has now filed a lawsuit and is demanding an independent investigation and what they call “better” officer training.
Malito’s death came just two weeks after the Illinois attorney general issued a proclamation. a three year report Turns out Joliet police have a habit of using excessive force.
The investigation was requested as follows Eric Lurry’s death in custody in 2020. It was determined that Lurry died due to a Fentanyl overdose. At the time, police said they tried to remove the drugs from his mouth and were not responsible for his death.
