Irish wife, 38, who groped 18-year-old Swedish man in Magaluf hotel sauna because she thought he ‘was interested’ faces 18-month jail sentence

A married Irish woman accused of sexually assaulting a tourist nearly 20 years her junior at a Magaluf holiday hotel has been warned she faces 18 months in prison if convicted.

The woman, who was now 38 but was 37 at the time of the alleged attack, appeared in court after being arrested for allegedly touching a Swedish man’s genitals without his consent in a Turkish steam bath.

The woman spent a night in a police cell before the investigating judge released her on bail and said she was free to return home pending the ongoing criminal investigation.

Prosecutors have now charged him and said they want him to get a year and a half in prison if he is found guilty at trial.

The sexual assault allegedly took place at around 18:00 on June 3 at the four-star Hotel Martinique in Magaluf, when the Irish woman from County Cork was only 37 and the young man was only 18.

In the three-page indictment, in which prosecutors describe the events, it is stated that after sharing the sauna with him and taking a dip in the hotel pool, she sat next to him when he went to the Turkish steam bath and ‘in a lustful spirit, taking advantage of the fact that no one was there and against her will, placed her hands on his genitals and caressed them until the man said “No, no, no” and left.

In addition to the prison sentence, prosecutors want the Irish woman to be banned from working with minors for two years longer than the prison sentence imposed and to be ordered to pay court costs if she is found guilty.

They also want her to pay £440 compensation to her male accuser.

Two police officers, along with the alleged criminal and the victim, will be called to testify.

The possibility of a pre-trial hearing to see if a plea bargain agreement could be agreed was not ruled out.

Well-placed sources said that the Swedish man was already in the hotel sauna when the female tourist was arrested, when the woman walked in, sat next to him and began chatting with him after asking him how long he was staying in Magaluf.

According to the police report sent to the court of inquiry, he left the sauna, dived into the swimming pool next to it and then entered the Turkish steam bath.

He warned hotel staff, who called the police after the alleged attack.

Reports at the time said the Irish woman, who was born in Brazil, was with her husband when police arrived and took him away.

Well-placed sources confirmed that he admitted touching the Swedish holidaymaker’s genitals when he went to court the day after his arrest after an initial denial to police in June, but he insisted it was a misunderstanding and after some small talk he said he thought he was interested in her. There is no mention of this in the prosecutor’s indictment.

His lawyer, Joan Arbos, a well-known Palma-based lawyer, said earlier this year that he would ask for the case against his client to be ‘discontinued’ on the grounds that ‘he does not think a crime has been committed’.

He could not be reached for comment this morning.

A Civil Guard spokesman described the Swedish man as 20 years old shortly after the arrest, but the prosecution indictment showed he was 18 at the time: ‘The 37-year-old alleged sexual attacker, who was in a sauna with a 20-year-old Swedish man, was accused of touching the victim’s private parts without her consent.

‘The victim was visibly upset when officers arrived.

‘After the investigations, they arrested the suspected attacker and handed him over to the court.’

A date has not yet been set for the hearing. In Spain, prison sentences of two years or less are normally suspended for first-time offenders.
