Title IX complaint filed against UW-Madison over transgender bathroom policy

SPECIAL: An education watchdog is filing a civil rights complaint with the Department of Education (DOE) against the University of Wisconsin-Madison for alleged violations of Title IX, which prohibits discrimination based on sex in schools.
Wisconsin’s flagship public university, home to 50,000 students, openly defies discrimination laws in an effort to accommodate transgender students at the expense of biological women, according to a complaint filed Wednesday by Defending Education.
At issue is the school’s “UW-6009: Inclusive Facilities Policy and Procedures for All Buildings.”

“Consistent with the University’s commitment to nondiscrimination and inclusion, students, staff, faculty, and visitors, regardless of gender expression or sex assigned at birth, have the right to use the restroom or facility that is most safe and comfortable for them without harassment or questioning,” the policy states. he says and adds: “[p]atrons may use the gendered restroom that is safest and most comfortable for them at all UW-Madison facilities.”
Defending Education says the policy guarantees biological males access to all private spaces for women on campus, including bathrooms and locker rooms, and that women have little recourse in the matter.
“If women are uncomfortable sharing multi-stall restrooms with biological males, the University instructs them to use limited gender-inclusive, single-occupancy restrooms,” Defending Education said on its website accompanying a copy of the complaint. “Forcing women to give up the private spaces and facilities guaranteed by Title IX is a violation of the spirit, history, and plain text of this law.”

In its letter to the DOE, the Department of Defense states that Title IX covers all facilities at a school that receives federal funding.
“UW-Madison’s restroom and locker room policy appears to violate Title IX and the Equal Protection Clause,” the letter states. “Accordingly, we request that the Department promptly investigate all allegations in this complaint, take swift action to correct unlawful policies and practices, and ensure that appropriate action is taken.”
Sarah Parshall Perry, vice president and legal counsel for Defending Education, told Fox News Digital that this is the group’s second civil rights complaint against the Wisconsin school for “discriminatory practices” in less than a year.

“The university’s policies are breathtaking in the breadth of their preference for transgender individuals, leaving biological women at the university without recourse, and patently violating Title IX, a law passed expressly to ensure educational equality for women and for no other purpose,” he said.
“The university is on the wrong side of the law and probably knows it. Now the United States Department of Education knows it too.”
