FIR filed against Kerala MLA Rahul Mamkootathil over alleged sexual exploitation, coerced abortion and threats

Kerala Police registered a first information report (FIR) against Palakkad MLA Rahul Mamkootathil after a woman accused him of repeated sexual abuse, false promise of marriage, forced medical termination of pregnancy, verbal abuse, death threats and various violations of the IT Act.
The police expedited the case after the woman and her family met at Chief Minister Pinarayi Vijayan’s office in the Secretariat on Thursday, November 27, 2025.
Later, a team led by District Police Chief Thiruvananthapuram Rural at KS Sudarshan recorded the woman’s statement.
Police registered the FIR at Valiamala police station in the early hours of Friday, November 28, 2025, and later transferred the case to Nemom police station, bringing the high-profile investigation under the jurisdiction of Thiruvananthapuram City Police Commissioner Thomson Jose.
In-camera spooling
The police will file a petition in the Neyyattinkara First Class Magistrate’s Court under Section 183 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) seeking to record the woman’s on-camera statement, a senior official said.
He said the charges against Mr Mamkootathil included rape, obtaining sexual consent by deceptive means, possibly through false promises of marriage, and forcing a woman to terminate her pregnancy regardless of the gestational age.
Drug Act violation
Police were also investigating Mr. Mamkooathil on charges of procuring miscarriage-inducing drugs without a prescription, using an acquaintance to deliver the pills to the woman, and forcing the woman to consume the drug; Meanwhile, it was claimed that he also watched the video call to ensure that the woman abided by the rules.
Police named Joby Thomas, a businessman in Pathanamthitta, who was an acquaintance of Mr. Mamkootathil, as the second accused in the case.
The charges against both included violations of the Medicines and Cosmetics Act and provisions of the Medical Termination of Pregnancy Act, which protect women’s reproductive rights, including those outside the purview of registered marriages.
An investigator said the law mandates that only doctors can administer abortion pills after various tests, including an ultrasound scan. Moreover, selling or distributing abortion pills without a prescription puts the supplier in legal danger.
Forensic role
The police will seek help from the State Forensic Science Laboratory to verify whether the voice messages attributed to Mr. Mamkootathil on social and traditional media are genuine or have been fabricated and falsified to discredit the legislator, officials said. Audio forensic results will inform the CT angle of the case.
The police will also seize the mobile phones allegedly involved in the crime and obtain a Section 65B certificate under the Indian Evidence Act to admit them as evidence in court. They will also use the Cyber Forensic Science Wing to examine timestamps and formatting to tamper with digital evidence, prove ownership of the device and analyze metadata as part of the rapidly evolving investigation.
Suspension of the party
The Congress had suspended Mr Mamkootathil from its primary membership in August after accusations of serial sexual misconduct, stalking and predation, including incriminating audio clips and text messages, went viral on social and traditional media, possibly putting the Opposition United Democratic Front (UDF) on the defensive.
The party had also removed Mr Mamkooathil from his post as State Youth Congress president.
