Pentagon probing misconduct allegations against Sen. Mark Kelly

The Pentagon said Monday it was reviewing what it called “serious allegations of misconduct” against Sen. Mark Kelly of Arizona, who was among six Democratic lawmakers harshly criticized by President Donald Trump for urging members of the military to refuse to obey illegal orders.

The Defense Department did not detail the allegations against Kelly, a retired U.S. Navy captain. The ministry also did not say who made the allegations.

The Pentagon said it was “initiating a comprehensive review of these allegations to determine further steps, which may include recall to active duty for war court proceedings or administrative measures.”

“This matter will be handled in accordance with military law, ensuring due process and impartiality,” the Pentagon said in its statement.

“The Ministry of War provides all individuals with military pensions [Uniform Code of Military Justice] for applicable crimes, and federal laws, such as 18 USC § 2387, prohibit acts intended to interfere with the loyalty, morale, or good order and discipline of the armed forces.”

“All servicemembers are reminded that they have a legal obligation under the UCMJ to comply with lawful orders and orders are presumed to be lawful,” the post said. “A soldier’s personal philosophy does not justify or excuse disobedience of an otherwise lawful order.”
