Marine Le Pen appeal verdict: Why Tuesday’s ruling matters for France

This appeal decision will determine Le Pen’s political future and, in fact, fire the starting gun of the presidential race. The first round will be held on April 18, 2027, and the second round will be held on May 2.

He was banned from holding public office for five years on 31 March 2025 when a court found him guilty of embezzling €1.4 million (£1.2 million) in European Parliament (EP) funds to pay his own party staff instead of parliamentary assistants between 2004-16. Le Pen was a member of the European Parliament (MEP) between 2004-17.

He was also given a four-year prison sentence; two of them were suspended and two were sentenced to home detention with an electronic tag.

Le Pen was revealed to have either approved or tolerated the fake jobs plan, and the decision excluded her from the 2027 elections.

During the appeal in January and February, Le Pen denied organizing the fraud but acknowledged “a mistake” that led to some parliamentary aides working “in the interest of the party”.

Prosecutors are seeking a continuation of the initial five-year ban on public office, along with a four-year sentence that includes a one-year sentence with an electronic tag and a three-year suspended sentence.

Le Pen said she was not afraid of the decision but believed it was “not possible” for her to run for president if the judges decided she should wear the label.
