President SantaCon He was arrested on Wednesday federal criminal indictment New York federal prosecutors said they accused him of using the ticketed Christmas bar-crawl event to divert hundreds of thousands of dollars earmarked for charities to personal use.
According to the indictment unsealed in the U.S. District Court for the Southern District of New York, defendant Stefan Pildes, who claims to have received no compensation from SantaCon, allegedly spent the transferred funds on extensive renovations of a lakeside property in New Jersey, luxury vacations in Hawaii, Las Vegas and Vail, Colorado, concert tickets, extravagant meals and a luxury vehicle.
The indictment states that approximately $124,000 of the SantaCon fund was spent on renting a luxury apartment in Manhattan, and another $100,000 was invested in a boutique resort in Costa Rica founded by a friend of Pildes.
According to the indictment against him, Pildes “donated only a small portion” of the approximately $2.7 million raised from SantaCon, which went to charity.
Pildes, 50, “promoted SantaCon as a charity-driven event, but instead of donating the millions of dollars he raised, he ran his own scam,” U.S. Attorney Jay Clayton said in a statement.
“He tapped into New Yorkers’ generous holiday spirit to fund his lifestyle with personal expenses large and small,” Clayton said.
Prosecutors said Pildes raised at least $2.7 million for charity from 2019 to 2024, but more than half of that money for his nonprofit group Participant Security was funneled into “a slush fund.”
A Hewitt, NJ resident has been charged with one count of wire fraud. He is expected to appear in Manhattan federal court Wednesday afternoon.
The indictment came more than two years later news site Gothamist rIt reported that an analysis showed Participant Security “raised $1.4 million through its SantaCon program from late 2014 through the end of 2022,” but “less than a fifth of that money went to registered nonprofits.”
“More than a third of the organization’s total donations at the time went to groups or individuals who appeared to be affiliated with Burning Man, a week-long annual festival in Nevada, including events for hula hoops, dance parades, free costumes and more,” Gothamist reported.
The report noted that Participant Security’s largest donation went to a “for-profit organization”: $66,340 to Spectaculum Productions, LLC, producer of the documentary film “At Your Cervix” about pelvic exams performed by medical students on unconscious and non-consenting patients.
In 2018, Participant Security “lost $17,498 of its investments in cryptocurrencies, equal to nearly one-third of its philanthropic donations that year,” Gothamist reported. “More than $832,000 (or 59%) of the money raised from SantaCon programs went to the nonprofit’s expenses, excluding charitable donations.”
Prosecutors said he “defrauded tens of thousands of people and small business owners who attended” SantaCon, which annually draws about 25,000 people dressed as Santa Claus and other holiday characters to bars and restaurants in New York City. Tickets for the event range from $10 to $20.
Prosecutors said Pildes chaired and controlled Participant Security Inc., the nonprofit organization that organized SantaCon.
The indictment against him stated that attendees were told that proceeds from SantaCon would go to various charities. The indictment stated that in December 2024, Pildes posted on his website that the ticket money went “directly to Santa’s charity campaign” and that “your money will be divided among the various charities listed on this page, as well as local charities along Santa’s route.”
Pildes “allegedly stole Christmas from tens of thousands of victims and deprived local charities of more than a million dollars,” said James Barnacle, Jr., FBI Deputy Director in Charge of the New York Field Office.
“The FBI continues to root out traitors who greedily exploit the goodwill of New Yorkers,” Barnacle said in a statement.
An attorney for Pildes did not immediately respond to a request for comment.
