Citing the “terror” felt by Americans struggling to meet basic nutritional needs, Judge McConnell ruled after an emergency one-hour hearing that the suspension of SNAP funding was arbitrary and could cause irreparable harm.

“There is no doubt, and beyond this debate, that irreparable damage will begin to occur (if it has not already occurred) due to the terror created by some people over the availability of food finance for their families,” he said.
The Trump administration said in a later filing following the judge’s oral ruling that it “expeditiously sought to comply” with Judge McConnell’s decision. Justice Department attorneys argued that there was no public tape or transcript of Friday’s emergency session and asked McConnell to provide clarification to ensure his decision complies with the rules.
“Clarity regarding the Court’s decision is critical to ensuring that Defendants can comply with the Court’s order while avoiding an operational collapse,” Justice Department attorneys wrote.

Judge McConnell ordered the Trump administration to notify the court about SNAP funding by Monday and continue supporting the program using emergency funds.
Judge McConnell ruled that the decision to halt SNAP funding was arbitrary and capricious and violated the Administrative Procedure Act. “No explanation, legitimate or otherwise consistent with the APA, has been made as to why emergency funds should not be used,” he said.
