US President Donald Trump is making changes to the H-1B visa program, the latest of which is the proposed “Reforming the H-1B Nonimmigrant Visa Classification Program” rule to tightly control immigration rules for foreign workers. This move could potentially change the way U.S. companies hire skilled foreign workers. The program was listed in the Federal Register at the end of September. According to the Department of Homeland Security (DHS), the proposal aims to “review eligibility for cap waivers, provide greater scrutiny for employers who violate program requirements, and increase oversight of third-party placements.”

DHS also said the changes are meant to “improve the integrity of the H-1B nonimmigrant program and better protect the wages and working conditions of U.S. workers.”

What are the changes proposed by the Trump administration?

Under the new H-1B visa rule, the program allows U.S. employers to hire foreign workers in “specialty occupations.” The new rule recommends:

– Shortening the definition of “specialty occupation,” which would potentially limit eligibility criteria to jobs that require a degree in a “particular directly related specialty.”

-Monitoring and limiting exemptions to the annual visa ceiling currently valid for universities, research institutions and healthcare institutions.

– Increase oversight of companies that place workers at customers’ facilities.

-Restrict compliance standards of companies that have previously violated employment or wage rules.

What are the changes to the H1B visa?

The Donald Trump administration announced at the beginning of September that H1B work visas would be increased by $100,000. This move angered thousands of Indian professionals who wanted to work in the US on the basis of this visa. Days later, Commerce Secretary Howard Lutnick said there would be “a significant number of changes” to the H1B visa process ahead of February 2026.
