Virginia Gov. Spanberger restricts ICE cooperation amid federal pushback

Immigration enforcement is an essential federal power. Under Article 1 of the Constitution, Congress has the duty to write our federal immigration laws. Under Article II, the President has the duty to implement them. States cannot interfere and certainly cannot prevent. Unfortunately, many Democratic states, especially Virginia, are on a deadly collision course with the federal government.

American voters have given President Trump and the Republican-led Congress a sweeping mandate to reverse the disaster the Biden-Harris border policy has caused in every state in America by mass importing up to 20 million illegal aliens, including some of the worst on Earth. Activist judges and other Democratic politicians and election deniers have done everything they can to thwart Trump’s constitutional duty to deport these dangerous illegal aliens.

The latest example is Virginia, which has passed a series of unconstitutional laws that would dangerously and illegally hinder ICE. These proposals include criminal penalties; This means state law enforcement will try to arrest and jail ICE officers for simply doing their job. This effort is seditious, riotous, extremely dangerous and clearly unconstitutional. For the good of the Republic, the Department of Justice must immediately and aggressively suppress this seditious conspiracy in Virginia.

Fairfax County District Attorney Steve Descano is Soros’ puppet Democratic prosecutor in suburban D.C., an ultra-wealthy Democratic enclave with an albatross around Virginia’s neck. Abdul Jalloh is an illegal alien who invaded our country in 2012. Jalloh settled in Virginia and began wreaking havoc on the good citizens there, leading to over 30 arrests. These included an accusation of rape and stabbing four Americans. Thanks anyway Willful incompetence of Fairfax County’s Democratic regimeJalloh had only one felony conviction. He violated his parole, spent three months in jail, and was released due to an agreement between his attorney and Descano’s office. Sanctuary jurisdictions like Fairfax County do not notify ICE when detaining or releasing illegals like Jalloh, who has a final removal order starting in 2020. Police in Fairfax repeatedly warned Descano’s office via email that releasing Jalloh would endanger the public, but the pleas fell on deaf ears. Earlier this week, Jalloh allegedly stabbed innocent 41-year-old mother Stephanie Minter to death at a bus stop.

Virginia Governor Abigail Spanberger ran as a moderate Democrat. However, after taking office this year, he immediately showed his true leftist face. He issued an order banning cooperation between government officials and ICE. Several anti-ICE bills are awaiting Spanberger’s signature: (1) a ban on ICE arrests in courthouses (places that dangerous, alleged illegals visit every day); (2) banning ICE arrests within 40 feet of polling places (where illegals violate federal criminal laws by voting); and (3) criminal penalties for ICE agents who wear masks (because they don’t want their personal information compromised and killed).

If Spanberger signs these unconstitutional state laws, the Trump Justice Department should immediately sue and seek to enjoin them in court. A federal judge in Virginia should issue a preliminary injunction consistent with a decision by the U.S. Court of Appeals for the Ninth Circuit that struck down California’s unconstitutional ban on ICE agents using masks altogether.

But civil sanctions are not enough. Virginia Democratic officials who plan to arrest ICE agents for doing their jobs (seditious conspiracy under 18 USC § 2384), and especially those who cause arrests (riot, assault, kidnapping, harboring, conspiracy, and more under 18 USC § 2383) – should go to federal prison for the serious federal crimes they have committed. If anyone is killed in the deadly conflict between these new Virginia confederates and ICE, these Virginia Democratic officials will face felony murder charges.

Former President Biden and his missing border czar, Kamala Harris, allowed millions of illegal immigrants to flow into our borders, including some of the world’s most violent and dangerous criminals. Trump is doing everything he can to enforce his broad election mandate and undo the damage by arresting and deporting these illegals.

Virginia’s proposed laws not only ban communications between state authorities and ICE; instead, they criminalize federal law enforcement actions that clearly fall within federal immigration enforcement authority.

States are not required to assist ICE by, for example, providing law enforcement resources to help ICE apprehend illegal individuals. But states certainly cannot subvert or obstruct these federal efforts. This is especially true of Virginia’s attempt to arrest on-duty ICE agents, which could justify their use of deadly force.

Virginia’s attempt to circumvent and obstruct federal law must fail. We fought the Civil War because the Confederacy, headquartered in Virginia, tried to override federal law regarding slavery. Today’s Virginia Democrats are returning to their confederate roots. As the federal government did during the Civil War, and throughout a century in which segregationist states continued their efforts to override federal laws, the federal government must now stand strong against Virginia’s rebellion and insurrection. The Supremacy Clause of the Constitution makes clear that federal law is superior in areas over which the federal government has jurisdiction.

If Virginia gets away with effectively invalidating federal immigration enforcement, other states can overrule other federal laws they don’t like. Let’s hope Abigail Spanberger comes to her senses and vetoes this madness. Otherwise, the federal government must use all the tools at its disposal, including the Sedition Act of 1807 and other federal criminal statutes, to uphold federal law. Virginia state officials should go to federal prison for their involvement in seditious conspiracies, riots, and other very serious federal crimes. Anything less would threaten the existence of the Republic.
