Florida Attorney General James Uthemeier issued an opinion declaring that state laws providing for discrimination based on race are unconstitutional and will not be enforced by his office.
“Racial discrimination is wrong. It is also unconstitutional. But Florida maintains many laws on its books that encourage and mandate segregation,” Uthmeier said. he said. idea.
“The legal question presented here is: Are Florida laws that mandate discrimination based on race by giving preferences to certain racial groups, using race-based classifications, or imposing racial quotas constitutional? The short answer is no. Any law requiring state action based on race is presumptively unconstitutional under the Equal Protection Clause of the Fourteenth Amendment and Article I, section 2, of the Florida Constitution,” he said.

“As attorney general, I and my office must respect the U.S. and Florida Constitutions’ guarantee of equal protection under the law. Because enforcing and complying with these discriminatory laws would violate fundamental legal guarantees, these laws are unconstitutional,” he said. “Therefore, my office will not defend or enforce any of these discriminatory provisions.”
