Accused High Country killer refused bail over missing camper case
The former pilot accused of killing camper Carol Clay and burning her remains in the High Country will remain in prison after he was denied bail.
Greg Lynn, 59, was granted a retrial in December over allegations he fatally shot pensioner Clay, 73, in the head while he was camping in the Wonnangatta Valley with his friend Russell Hill, 74, in March 2020.
His legal team argued that he should be released back into the community while awaiting the outcome of a new trial.
At last week’s hearing, defense lawyer Dermot Dann, KC, argued that his client could live with his eldest son, Geordie Lynn, who owns property that he was prepared to offer as surety to secure his father’s release.
The family home Lynn shared with his wife Melanie in Caroline Springs could not be used as a bail guarantee due to the application for a restriction on the property.
On Thursday, Judge David Beach disagreed with the defense.
Applying for bail last week, Dann said Lynn had been assaulted while in custody, was kept under guard and had a heart condition.
KC Prosecutor Mark Gibson opposed bail, telling the court they had a strong case against Lynn, which included Clay being shot in the head by a bullet from the former Jetstar pilot’s gun while he was near the rear wheel of a vehicle.
The matter will then be brought back to court. A new trial date has not been set.
