Alec Baldwin to head back to court for ‘Rust’ civil lawsuit: report

Diversity And People On Friday, a Los Angeles Superior Court Judge ruled that a civil lawsuit filed by a “Rust” crew member can proceed to trial. Cinematographer Halyna Hutchins died in October 2021 as a result of the gunfire that Baldwin was holding.

“A reasonable jury could conclude that Mr. Baldwin recklessly disregarded the possibility that pointing a gun at someone with his finger on the trigger would cause emotional distress,” the judge wrote in the filing obtained by Variety.

Fox News Digital has reached out to Baldwin’s representatives for comment.

While the “30 Rock” actor initially faced criminal charges, a Santa Fe judge rejected Baldwin’s involuntary manslaughter plea Prejudice charge July 2024.

Serge Svetnoy first sued Baldwin in 2021, less than a month after Hutchins’ death.

“Simply put, there was no reason for a live bullet to be chambered in that .45 Colt pistol or to be found anywhere on the Rust set, and the presence of a bullet in a pistol posed a lethal threat to anyone around it.” was read in his trial at that time.

Svetnoy stood behind the monitor and about five to six feet away while Baldwin rehearsed the scene the crew was about to shoot. Baldwin was performing a cross-drawing maneuver when the gun was fired.

Svetnoy, the film’s foreman, spent the next 20 to 30 minutes helping Hutchins after realizing the cinematographer had been shot. Only after paramedics intervened did Svetnoy realize the seriousness of the situation.

“Defendant Baldwin realized that he was in the danger zone posed by the loaded gun in his hand, and that the sensation he felt from the firing of the Colt Revolver was not just compressed air,” the civil lawsuit states. “But for an inch or two, probably less, that bullet could have ended his life.”

According to Svetnoy’s lawsuit, Baldwin should not have fired a gun during the scene they filmed on that fateful October day.

“The scene did not call for Defendant Baldwin to shoot the Colt Revolver, which was not supposed to contain any live ammunition,” the lawsuit said.

Baldwin has maintained in many interviews that he did not pull the trigger of the gun. The actor described the moment the gun was fired on a television show in December 2021, months after the deadly shooting.

Svetnoy was not injured in the conflict.
