YMCA faces pressure to change locker room policies after Title IX ruling

FIRST ON FOX: The YMCA is facing new pressure to change its policies regarding transgender individuals’ access to gender-segregated locker rooms, sports teams and overnight accommodations after the American Parents Coalition (APC) argued that the organization’s rules conflict with the Supreme Court’s recent Title IX decisions.

The coalition argued that the nonprofit, which operates nearly 2,600 locations nationwide and receives more than $600 million in government funding annually, should update its policies to comply with the Supreme Court’s interpretation of Title IX because it accepts taxpayer funding.

In a letter sent this week to YMCA President and CEO Suzanne McCormick and the organization’s board of directors, APC called on the organization to review its policies regarding athletics, bathrooms, locker rooms and overnight accommodations following the Supreme Court’s June 30 decisions in West Virginia v. BPJ and Little v. Hecox. In a 9-0 decision, the Supreme Court ruled that states can limit sports for women and girls to biological women and that the use of the word “sex” in Title IX refers to biological sex.

“The Supreme Court has drawn an unswerving line in reaffirming that Title IX’s protections are based on biological sex,” American Parents Coalition Executive Director Alleigh Marré said in a statement. he said. “For too long, the YMCA has ignored parents’ concerns while continuing policies that undermine the privacy, security, and fairness that Title IX is enacted to protect. The court’s decisions should serve as a wake-up call for every federally funded institution.”

The coalition calls on YMCA leadership to rescind policies that allow biological males to participate in women’s sports or access women-only restrooms, locker rooms, and overnight accommodations, to issue updated policies that recognize gender-based protections for women and girls, and to publicly announce the organization’s commitment to complying with Title IX.

“The Supreme Court has now made clear that biological sex is a legally valid distinction under Title IX,” the letter said. The statement is included. “The YMCA faces a choice. It can reinstate policies that protect women and girls, rebuild parents’ trust, and align its practices with the laws interpreted by the highest court in the land.”

BIDEN OFFICIALS MISSED COURT ORDER IN TITLE IX CASES, INCLUDING BOYS’ IN GIRLS’ SPORTS, DOCUMENTS SHOW

The letter marks the latest step in APC’s year-long campaign targeting the YMCA’s transgender inclusion policies. Last year, the organization filed Title IX complaints with the Departments of Education, Health and Human Services, and Housing and Urban Development, alleging that the YMCA’s policies violated federal civil rights law. He also asked Congress to investigate the YMCA’s use of federal funding.

The APC argues that although the Supreme Court’s recent decisions focus on women’s sports, the Court’s reasoning also extends to other gender-segregated areas. The group argues that YMCA policies that allow individuals to use bathrooms, locker rooms, overnight lodging and join sports teams based on their gender identity are inconsistent with the Court’s interpretation of Title IX.

The coalition also alleges that web pages describing some of the YMCA’s gender identity policies were removed or revised after public review, but did not change the underlying policies. APC also alleges that some YMCA camps continue to allow counselors to stay in cabins that match their gender identity rather than their biological sex.

An investigation by Fox News Digital found that many local YMCA associations, including the Metropolitan YMCA of Detroit, the YMCA of Lakeland Hills in New Jersey, and the YMCA of the Gateway Area, maintain policies that allow members to use bathrooms and locker rooms that match their gender identity.

The renewed criticism comes a month after an altercation at the San Francisco YMCA attracted national attention. After months of complaints from some members about a transgender woman’s use of the women’s locker room at the Stonestown location, the facility adopted updated locker room rules that emphasize that nudity must be “confidential, limited and brief” while instructing members to respect the privacy and personal space of others. The revised rules addressed behavior in the locker room but did not change the YMCA’s policy allowing transgender members to access facilities consistent with their gender identity.
