Attorneys urge judge to visit ‘Alligator Alcatraz’ to assess detainees’ access to lawyers

ORLANDO, Fla.. (AP) — Lawyers of the detainees immigrant detention center inside Florida Everglades The group known as “Crocodile Alcatraz” wants a federal judge to make an unscheduled, in-person visit to the facility to see firsthand whether they have adequate access to their lawyers.

Lawyers on Friday asked U.S. District Judge Sheri Polster Chappell to visit within the next two months to assist with the evaluation. The detainees’ federal lawsuit claims their lawyers must make an appointment three days in advance to visit, unlike other immigration detention centers where lawyers can only arrive during visiting hours; detainees are often transferred to other facilities after their lawyers make an appointment to meet with them; and scheduling delays were so long that detainees were unable to meet with lawyers before important deadlines.

“Federal courts regularly conduct field visits as a valid means of gathering information, especially in cases involving conditions of solitary confinement,” the detainees’ lawyers wrote in their request.

But Florida state attorneys “strongly” opposed the visit, saying a federal judge does not have the authority to inspect a government facility and that the visit would pose significant security risks.

“This would also place a significant burden on facility staff and significantly disrupt the facility’s operations,” Florida state attorneys said.

As of Monday, the judge had not ruled on the request.

The judge, sitting in Fort Myers, Florida, ordered lawyers for the detainees and attorneys from the state and federal government to meet last week to try to resolve the case. However, despite nine hours of talks, no conclusion was reached.

The lawsuit, which concerns access to the legal system, is one of three federal lawsuits challenging immigration detention center practices. Another lawsuit filed by detainees in federal court in Fort Myers argues that immigration is a federal matter and that Florida agencies and private contractors hired by the state do not have the authority to operate the facility under federal law. a judge was rejected last week Detainees’ request for an injunction to close the facility.
