Bar indispensable in upholding sanctity of Constitution: CJI Surya Kant

Chief Justice of India Surya Kant, in his statement on Wednesday, November 26, 2025, said that the Bar Association has an indispensable place in strengthening the rule of law and protecting the sanctity of the Constitution, and also emphasized its importance in providing legal assistance to the vulnerable and marginalized.
Addressing a meeting at the Constitution Day event organized by the Supreme Court Bar Association, the CJI said he has time and again recognized the invaluable role of the judiciary in upholding the virtues of the Bar Association.

“As we celebrate the momentous moment when the people of India gifted themselves with the most fundamental treaty, I stand before you and must emphasize that the Bar has an indispensable place in strengthening the rule of law and preserving the sanctity of our Constitution…
“If the courts are seen as the guardians of the Constitution, I have no hesitation in saying that the members of the Bar are the torch bearers who light our way. They help us fulfill our sacred duty with clarity and conviction,” said Justice Kant.
He said that he often talks about the invisible victims of the judicial system and sincerely believes that only the Bar Association can save them from this pain.
“Your perspectives are extremely important, and the seriousness you bring to your craft directly impacts the transformation of our constitutional future.

“In addition to assisting us on constitutional matters, it is equally vital that the Bar collectively takes decisive action to unveil the letter and spirit of our founding document. This includes providing legal assistance to those who are vulnerable or living on the margins of society, as well as aligning with the vision contained in the Directive Principles of State Policy,” he said.
According to Solicitor General Tushar Mehta, the beauty of the Constitution is that the three wings – judiciary, executive and legislature – are independent from each other and at the same time there are internal checks and balances.
“If the executive does something contrary to the Constitution, the judiciary has superiority. But ultimately, no body is superior and sovereign; only the Constitution is supreme and sovereign.
“In cases where the legislature has strayed from the path of constitutional morality or constitutional morality, the judiciary as an institution has stepped in and the judiciary has played a very important role in ensuring that the Constitution functions as designed and as understood by the framers of the Constitution,” Mehta said. he said.

SCBA president and senior advocate Vikas Singh said the law can be meaningful and accessible to all only if three elements of the legal system are taken into account: law making, delivery of justice and access to the system of justice delivery for all.
He raised the issue of black money in elections and said people with criminal backgrounds are coming to Parliament.
“This is definitely an area where we need to introspect and see what best can be done to ensure the right people are elected to Parliament,” Singh said.
The SCBA president said the infrastructure of the lower courts was terrible and also highlighted the issue of training of judges.
November 26 is celebrated as Constitution Day since 2015 to commemorate the adoption of the Constitution of India by the Constituent Assembly in 1949. The day was previously celebrated as Law Day.
