Blackburn pushes to disbar Jack Smith over alleged phone record surveillance

FIRST ON FOX: Sen. Marsha Blackburn, R-Tenn., was one of nearly a dozen Senate Republicans allegedly investigated by former Special Counsel Jack Smith; It was an investigation of which he was unaware until earlier this month.

He was one of several Senate Republicans who Smith allegedly spied on as part of his investigation into the Jan. 6, 2021, Capitol riots. But Smith’s alleged request for phone records about himself and others was uncovered by the FBI earlier this month — thanks to an surveillance request from Senate Judiciary Chairman Chuck Grassley, R-Iowa.

Blackburn told Fox News Digital in an exclusive interview that he was unaware that Smith’s phone records were being spied on until documents from the “Arctic Frost” investigation emerged.

He believed the “common thread” behind the former special counsel’s investigation in 2023 was that “all eight of us are Republicans. We all support President Trump.”

Blackburn and Sens. Lindsey Graham, R.S.C., Ron Johnson, R-Wis., Josh Hawley, R-Mo., Cynthia Lummis, R-Wyo., Bill Hagerty, R-Wyo., Dan Sullivan, R-Alaska, Tommy Tuberville, R-Ala. and Rep. Mike Kelly, R-Pa., were reportedly part of Smith’s investigation.

In response, Blackburn and many others who allegedly spied on Smith are calling for him to be disbarred.

“This is about making sure we have one-tier justice and stopping that two-tier justice,” Blackburn said. “And if they can do that to eight sitting U.S. senators, what can they do? I mean, think about how, what they’ve done to conservatives in this country.”

Last week he and Graham, Tuberville, Sullivan and Kelly, a letter He appealed to Attorney General Pam Bondi, requesting that Smith be investigated and referred to the Department of Justice (DOJ) Office of Professional Responsibility.

The ultimate goal of the investigation is to see Smith disbarred from New York and Tennessee, the two states where he is licensed to practice law. Blackburn argued that Smith’s claim that he spied on her and others was a “First Amendment and Fourth Amendment violation.”

His latest move against the former special counsel comes on the heels of another letter sent to AT&T, T-Mobile and Verizon demanding why the cell phone carriers allegedly allowed the FBI under Smith and the Biden administration to monitor their communications.

“You would think that because of the Preserved Records Act and the First Amendment, the Fourth Amendment, and the Speech and Debate Clause, at least Verizon, my wireless carrier, would notify me that there was a request for my records,” he said.

“But of course we were given nothing, and that’s why we sent this letter to Verizon and then sent a letter to the Department of Justice about Jack Smith,” he continued.

Smith is one of a handful of former officials targeted by the Justice Department under the Trump administration. He is currently under investigation by the Special Counsel Office for alleged violations of the Hatch Act, which prohibits government employees from participating in political activities.

There are also federal indictments against former FBI Director James Comey for allegedly making false statements and obstructing justice, and against former National Security Advisor John Bolton for allegedly mishandling classified documents.

Blackburn was one of many Republicans who spoke out against President Donald Trump’s so-called political witch hunt against him while he was out of office. Asked what the difference is between the accusations against Trump and his allies and the latest accusations by former officials, he said it’s about accountability.

“These need to be investigated to stop such incidents,” Blackburn said. “And I think one of the differences you see between Democrats and Republicans is Democrats circle the wagons over and over again, pushing everything under the rug, and then they want two-step justice. With Republicans, the focus is on accountability and transparency, and I think that’s a huge difference.”
