Border Patrol arrests illegal immigrant truck driver with valid New York CDL

Border Patrol agents stopped a commercial truck at an internal checkpoint near Blythe, California, where they discovered the driver, a 25-year-old Indian citizen with a valid New York commercial license, was in the United States illegally.
“Blythe Station agents arrested a commercial truck driver at an immigration checkpoint after discovering he was in the United States illegally,” the lead patrol agent in the Yuma Sector wrote in a post on X. “The truck driver, a 25-year-old Indian citizen, had a commercial driver’s license issued by the state of New York. He was arrested for nonadmission of aliens pursuant to 8 USC 1182 and will be processed for deportation.”
The arrest comes amid a court battle over Department of Transportation restrictions on illegal immigrants obtaining commercial driver’s licenses.
Transportation Secretary Sean Duffy reacted Monday to a court decision rejecting the Trump administration’s request to block illegal immigrants from getting CDLs.

“We’re not just going to work this out,” Duffy said on “The Ingraham Angle.” “We will do everything we can to protect the American people.”
His comments came after a federal appeals court in Washington, D.C., ruled last Thursday that the Transportation Department’s restrictions were unenforceable.

Such restrictions were announced in September after illegal immigrant truck driver Harjinder Singh was accused of causing a crash involving a tractor trailer that killed three people in Fort Pierce, Florida.
The federal government did not follow proper procedure or explain how the rule would improve safety, the justices said. The court also noted that Federal Motor Carrier Safety Administration data shows that about 5% of all commercial driver’s licenses are held by immigrants, but they account for only 0.2% of fatal crashes.

Duffy placed much of the blame on the Biden administration, which he said allowed millions of illegal immigrants in, gave them work permits and then allowed CDL searches.
“People are dying,” he said.

“And we thought it was appropriate to protect Americans, and we thought we should have an emergency rule to avoid going through a month-long process. That’s what we did. The court took us back and said, ‘We’re not so sure this is an emergency. We want to see more data.’ And I think, ‘Watch any show on television, and you’ll see the risk to the American people.'”
