Could the White Australia Party win in the High Court?

The White Australia Party (WAP) is a new entity, an anonymous association formed by some remnants of the neo-Nazi National Socialist Network (NSN), which was listed as a proscribed hate group and therefore banned by Home Affairs Minister Tony Burke last week. WAP has applied to the Australian Electoral Commission to register as a political party.
